       Since the 18th National Congress of the Communist Party of China, the Hunan Provincial Party Committee and the provincial government have always adhered to the working principle of sharing the people’s legacy with the people, and adhered to the protection concept of "seeing people, seeing things and seeing life". In accordance with the unified deployment of the Ministry of Culture and Tourism, Hunan plans have been continuously launched, Hunan characteristics have been highlighted, Hunan voices have been made, Hunan brands have been formed, and a colorful and charming picture scroll of Hunan’s legacy has been laid out, which has become an important source of preserving Hunan spirit and a deep foundation for nourishing Hunan culture.

  First, build a working system and open up a "new world" for the protection of intangible heritage

  The first is to improve the protection laws and regulations.In June 2016, the second local regulation in Hunan’s cultural field and the first local regulation in the field of intangible cultural heritage, the Measures for Implementing the People’s Republic of China (PRC) Intangible Cultural Heritage Law, was promulgated. In 2014, the Provincial Party Committee Propaganda Department and the Provincial Department of Education jointly issued the Notice on Further Promoting the Work of Intangible Cultural Heritage in Campus. From 2019 to 2021, the relevant departments jointly issued the Plan for Revitalizing Traditional Crafts in Hunan Province, the Plan for Inheriting and Developing Quyi in Hunan Province and the Measures for the Administration of Provincial Cultural and Ecological Protected Areas in Hunan Province, and released the Catalogue for Revitalizing the First Batch of Traditional Crafts in Hunan Province, which fully played the role of laws and regulations in the protection, inheritance and innovation of intangible cultural heritage.

  The second is to improve the four-level directory system.Hunan is rich in intangible cultural heritage resources, and the national, provincial, municipal and county-level directory system is well established, with a total of 5,254 projects in 10 categories, including 137 national intangible cultural heritage representative projects, 410 provincial intangible cultural heritage representative projects, 4,707 municipal and county-level intangible cultural heritage representative projects, 121 national inheritors, 304 provincial inheritors and 4,416 municipal and county-level inheritors. Kunqu opera, shadow play, the custom of Dragon Boat Festival along the Guluo River and the 24 solar terms are listed in the representative list of intangible cultural heritage of mankind. Three projects, namely, making skills of Qianliang tea, making skills of Fuzhuan tea and making skills of Junshan Yinzhen tea, were included in the list of representative works of human intangible cultural heritage by the Ministry of Culture and Tourism. In 2021, it took the lead in the protection of red intangible cultural heritage in China, and included red intangible cultural heritage items such as Chaling Red Story, Shaoshan Red Story, Cai Hesen’s revolutionary story and the story of the Red Army’s Long March in Xinhua into the provincial intangible cultural heritage list, so that red culture could be integrated into the inheritance pedigree of Chinese excellent traditional culture.

  The third is to establish a non-legacy protection mechanism.The province has set up a provincial-level intangible cultural heritage protection center, 14 cities and states have set up 8 intangible cultural heritage departments (offices), 6 listed, 7 independent intangible cultural heritage protection centers and 7 listed; In 127 counties and cities in the province (including 4 local economic development zones), 19 independent intangible assets were set up and 108 were listed, and 33 independent intangible protection centers were set up and 92 were listed, achieving full coverage of the specialized institutions for intangible protection at the provincial, city and county levels, realizing the historical development of intangible protection forces from scratch. 18 departments, including the Propaganda Department of the Provincial Party Committee, the Provincial Development and Reform Commission, and the Provincial Department of Finance, established a joint conference system for the protection of provincial intangible heritage. Seven departments, including the Provincial Administration of Traditional Chinese Medicine, carried out collaborative protection of traditional medicine non-legacy departments, and the Hunan Provincial Department of Culture and Tourism became the first provincial-level cultural tourism department in China to implement collaborative protection of traditional medicine departments.

  Second, connect with modern life and open the "activation code" for intangible protection.

  The first is to create a cultural and ecological protection zone and build a Hunan model.Actively promote the construction of national-level Tujia and Miao cultural and ecological protection zones in Wuling Mountain Area (Xiangxi), explore a "four-in-one" construction model that insists on combining intangible heritage protection with cultural relics protection, project construction, cultural tourism industry and rural revitalization, and formulate more than 20 supporting local laws and policies on cultural and ecological protection, with a special investment of 1.057 billion yuan, and the investment and management level are in the leading position in the country. In 2019, Xiangxi Ecological Zone became one of the first seven national-level cultural and ecological protection zones in China. In 2021, the national cultural and ecological protection zone experience exchange activities were held in Xiangxi, and the Hunan practice of "four combinations" was promoted throughout the country.

  The second is to promote the deep integration of non-legacy and tourism.Intangible cultural heritage is the most dynamic, potential and suitable field for the integration of literature and tourism. After the central government put forward the development strategy of cultural tourism integration, in order to speed up the two-way journey between poetry and distant places and embrace each other deeply, in 2019, the Hunan Provincial Department of Culture and Tourism and Yueyang Municipal Government held a series of activities, including a traditional craft exhibition and a tea fair in a 5A-level scenic spot, an intangible theme evening with Yueyang Tower as the background, a collection of outstanding papers on intangible heritage and tourism, and an academic forum on intangible heritage and tourism. In 2020, the launching ceremony of the first Hunan Intangible Cultural Heritage Shopping Festival will be held on May 19th China Tourism Day and in Taohuayuan, a 5A-level scenic spot. In 2021, the main event of "Cultural and Natural Heritage Day" publicity and display will be placed in Nanyue Scenic Area. In 2021, the first batch of 10 non-legacy theme (research) tourist routes, such as the tour around the lake with plenty of rice, the tour of the Xiangjiang River with a thousand miles to explore the source of the non-legacy and the tour of the mysterious Xiangxi, were released, covering 100 counties (urban areas) in 14 cities (states), connecting 156 heritage sites in series and involving 367 non-legacy projects. In 2022, the United Provincial Administration of Traditional Chinese Medicine planned the trip of Chu Yun Hu Xiang to nourish the spirit, the trip of magical Xiang Dong to nourish the lungs, and the paradise.Six excellent routes of TCM health tourism, such as the journey of nourishing the heart, have evaluated a number of demonstration bases of TCM health tourism experience, and the degree of integration between intangible heritage and tourism has been continuously strengthened, and the integration effect has been continuously improved.

  The third is to implement the "non-legacy into campus" brand project.Thirty-three primary and secondary schools, including Mingde Tianxin Middle School in Changsha, and five universities, including Hunan Institute of Science and Technology, were identified as the intangible cultural heritage inheritance schools and practice bases in Hunan Province. More than 300 sets (volumes) of non-legacy teaching materials (readers) have been compiled, involving nearly 400 non-legacy representative projects such as Qi Opera and Huagu Opera. Local non-legacy knowledge has been integrated into "local teaching materials" and "school-based teaching materials", and the interest of "knowing hometown, loving homeland, understanding non-legacy and passing on culture" has been developed to help primary and secondary school students accept the nourishment of Chinese excellent traditional culture. In recent years, more than 13,000 non-legacy activities have been carried out on campus through non-legacy exhibition activities, covering 486 non-legacy projects such as Peking Opera, Flower Drum Opera, Changsha Tanci and Changde Sixian, covering nearly 800 schools of various types, benefiting more than 5 million primary and secondary school students, and promoting the formation of two brand activities, namely "drama animation enters the campus" and "small non-legacy inheritor". Hunan’s experience in non-legacy campus was presented at the national symposium on non-legacy protection.

  Third, serve economic and social development and enhance the "contribution rate" of intangible cultural heritage protection

  The first is to promote the revitalization of traditional crafts.Implement the traditional craft revitalization plan, set up the second national traditional craft workstation in Xiangxi, and realize the "four ones" goal of "exploring a basic way for traditional crafts to integrate into modern life, forming a research and development mechanism based on the design strength, brand image and market channels of the station-based units, cultivating a group of practitioners with high quality and wide coverage of traditional crafts, and launching a group of creative brands with Xiangxi as the core". Completed the implementation plan of 7 traditional craft projects such as beachhead woodblock New Year pictures, guided the establishment of 12 traditional craft project trade associations such as Hunan cuisine, organized the province to carry out 42 traditional craft revitalization trainings with more than 2,600 person-times, and established 5 traditional craft related majors and trained more than 1,300 graduates relying on Hunan Arts and Crafts Vocational College and other universities. Held the "Hunan Traditional Craft Revitalization and Development Forum" for two consecutive sessions, launched the online Hunan Traditional Craft Network, and released the "Blue Book of Hunan Traditional Craft Revitalization". Hunan Traditional Craft Expo was held for five consecutive years, and it was the first in the country to create a non-legacy museum on the cloud. In cooperation with the high-end aviation magazine "Zunpin", the special issue of "To Be Intangible and Respect for Ingenuity" was launched, with a circulation of 100,000 copies, and the revitalization of traditional crafts in Hunan was full of vitality.

  The second is to serve the country’s major strategy.Since 2018, we have continued to promote intangible assistance for precise poverty alleviation. In 51 poverty-stricken counties in the province, 152 workshops for intangible assistance for poverty alleviation have been set up, involving 194 intangible projects and 129,000 people, which has driven 72,000 people to work at home and helped 68,000 people get rid of poverty. Hunan’s experience of "intangible assistance+poverty alleviation" is a typical promotion in the country. In Xiangxi, relying on Miao Xiu, Miao costumes and other projects, we launched the "Let Mom Go Home" non-legacy poverty alleviation program, set up more than 20 training bases in Miao Xiu, and trained more than 6,000 embroidered mothers. The brand "Let Mom Go Home" was praised by name at the press conference held by the State Council Office to help the poor through culture and tourism, and was repeatedly reported by authoritative media such as Xinhua News Agency and China Central Radio and Television General Station, and its experience made a typical speech in the country three times. At present, intangible cultural heritage is being promoted to help rural revitalization. A total of 255 intangible cultural heritage workshops have been established in the province with a total investment of 2,169,451,500 yuan. At the beginning of this year, we took the lead in establishing provincial demonstration sites for non-legacy workshops, non-legacy villages and towns, and non-legacy blocks in China, and introduced relevant support measures to award 50 demonstration non-legacy villages, towns, blocks and workshops. Recently, the Ministry of Culture and Tourism entrusted five provinces in China with the pilot task of helping rural revitalization, and Hunan became one of the pilot provinces.

At the "Hunan First Intangible Shopping Festival and online celebrity Live Delivery Competition" held in Changde Taohuayuan Scenic Area, relying on Taobao, Pinduoduo and JD.COM, three "Hunan Intangible Heritage Museums" were opened, providing professional service for product exhibition and sales of 152 poverty alleviation and employment workshops, 139 intangible heritage projects and 259 inheritors in the province. More than 50 central and provincial mainstream media reported that active communication’s total exposure exceeded 400 million, driving the sales turnover of intangible products to exceed 600 million.

  Fourth, tell the story of Hunan well and expand the "circle of friends" for non-legacy protection.

  The first is to build a media communication matrix.Efforts will be made to build a "four-in-one" non-genetic broadcasting matrix covering TV, paper media, network and new media platforms, and a strategic cooperation will be reached with Beijing ByteDance, becoming the first provincial-level non-legacy administrative department in Tik Tok, and the coverage rate of non-legacy projects above the provincial level in Tik Tok is over 86.7%; Cooperate with Hunan Jingshi and China Communications Broadcasting to launch the columns of "Not Left in Hunan" and "Not Left on the Road", and broadcast a total of 320 programs; During the epidemic, the columns of "On the Cloud, Xiang Encountered Intangible Heritage", "Open Class of Intangible Heritage", "Learning Arts on the Cloud" and "Picking up Heritage on the Cloud" were launched, which were well received by netizens. During the "Cultural and Natural Heritage Day" this year, the propaganda film "Furong Guoli Xiang Encountered Intangible Heritage" was released, and three special programs with the theme of "Invisible Heritage Tourism is on fire", "Intangible Heritage Cross-border Tide" and "Intangible Heritage is alive" were planned and launched in the column "Jingshi Observation" of Hunan Jingshi, widely publicizing that intangible heritage helps tourism development, promotes rural revitalization and endowments.

We have successively held more than 40 special activities, such as Hunan Traditional Craft Expo, Hunan-Hubei-Jiangxi-Anhui Intangible Heritage Exhibition, and "BMW China Cultural Tour", which has guided various localities to carry out intangible heritage activities for more than a thousand times every year. Make full use of major node events to hold publicity and exhibition activities. In 2019, the 70th anniversary of the founding of the People’s Republic of China was jointly held with Yueyang City to hold the publicity and exhibition activities of Hunan’s intangible heritage, and in 2021, the centenary of the founding of the Party was successively held with "Greeting the centenary of the founding of the Party with outstanding achievements" — — The skills exhibition and exchange of national and provincial representative inheritors in Hunan Province, the invitation exhibition of Chinese embroidery art with the red theme of "Looking Back for a Hundred Years" and the series of exhibition activities of "Red Classics and Non-genetic Inheritance" in Hunan Province have greatly aroused the enthusiasm of the broad masses of the people for loving the party, patriotism and traditional culture.

  The third is to widely spread the intangible sound.Organize and participate in China International Import Expo, China Chengdu International Intangible Cultural Heritage Festival, China Intangible Cultural Heritage Expo, "Xinjiang is a Good Place" and other major global and national exhibitions. It has organized more than 100 non-legacy projects and more than 300 inheritors to visit more than 20 countries and regions, such as the United States, Britain and Germany, and participated in foreign cultural exchange activities such as "Happy Spring Festival", "Perceiving China" and "Huxiang Fenghua", showing the people of the world the profound heritage and unique charm of Huxiang culture. Organized the "Hunan-Poland-Czech Intangible Heritage Exchange Week" in Eastern Europe, which attracted more than 20 local mainstream media to report and reached millions of people, expanding the international communication and influence of Huxiang culture.

  Everything in the past is a preface. Hunan will continue to seriously study and thoroughly implement the spirit of the important exposition of the Supreme Leader General Secretary on the protection of intangible cultural heritage. The results show that at present, the rate of major projects in various places is relatively high, and the support policies and related guarantees are relatively adequate. However, most non-major projects still face outstanding problems such as low rate of workers returning to work, poor accommodation conditions on the site and rising prices of building materials, which greatly restricts the resumption of work and production. Since the first quarter is not the peak season of construction industry, many interviewed enterprises said that if the orderly resumption of work and production is realized as soon as possible, it is expected that the construction gap in the first quarter will be made up in the last three quarters.

Experts believe that the working environment of construction sites is low in standardization, the mobility of construction workers is high, the degree of professionalism is low, the level of standardized management is low, and there are big shortcomings in emergency response capacity. It is suggested that all localities should comprehensively consider and make precise policies on personnel prevention and control, transportation of epidemic prevention materials and building materials, and realistically adjust the corresponding charging standards in the cost quota for the shortage of labor and the increase of labor costs, so as to reduce the burden for enterprises reasonably and legally, and avoid enterprises from making subtraction on the project quality to make up for the losses under the dual pressure of labor shortage and time limit.

At this stage, we should accelerate the transformation and upgrading of traditional construction methods, vigorously promote prefabricated buildings and industrialized construction methods, take this epidemic as an opportunity to build an online employment information platform, and formulate relevant professional skills standards and evaluation norms for construction workers. The professionalization of construction workers can solve the problems of high turnover rate, high mobility and low sense of gain in the construction industry to some extent.

First, the construction site is facing multiple unfavorable factors.

In order to ensure the normal operation of the economy, all localities attach great importance to epidemic prevention work and actively guide construction sites to resume work in an orderly manner. However, due to multiple unfavorable factors, the resumption rate of projects under construction in many places is not high, the construction period is generally delayed, the payment of construction enterprises is not timely, and some enterprises even face the risk of capital chain breakage.

(1)The progress of resumption of construction in many places is slow.

According to the investigation, construction enterprises play a major role in the prevention and control of epidemic situation on site, and local governments are also continuously strengthening the guidance and supervision of epidemic prevention work on site and giving policy support to enterprises.

With the promotion of the Ministry of Housing and Urban-Rural Development and other local government departments, as of March 8, 111,900 of the 192,500 housing construction and municipal infrastructure projects in China have resumed work, with a resumption rate of 58.15%.

Compared with previous years, the downtime of this construction site has been significantly prolonged, and the project period has been generally delayed. Xinhua News Agency economic analysts believe that the slow progress of resumption of work will lead to delays in the construction period, project breach, pressure on construction enterprises, and the longer the shutdown time, the greater the adverse impact on enterprises and industries.

(1)The delay in construction period leads to a substantial increase in project cost.

According to industry insiders, the delay in the construction period will lead to the project not being delivered as scheduled, and the construction unit needs to pay liquidated damages to the construction unit according to the number of days of delay. The liquidated damages of individual projects are as high as tens of thousands of yuan per day, which directly leads to a substantial increase in the project cost.

There are two kinds of delays. First, the local government of the project explicitly requested to postpone the resumption of work, which led to the delay of the construction period. In this case, if the losses and expenses caused by epidemic prevention and control increase, the relevant clauses of force majeure in the contract shall apply, and the liquidated damages may be exempted if the delay is within the specified time. Affected by the epidemic situation, the possible price fluctuation of labor, materials, equipment and machinery shall be jointly borne by the contracting parties according to the actual situation of the project.

Second, there is no mandatory requirement to postpone the resumption of work at the location of the project, but the labor or materials needed for the project are suspended, which indirectly affects the resumption of work. In this case, although according to the provisions of the contract law, the epidemic constitutes force majeure, and the construction unit has the right to waive its liability for breach of contract by claiming to postpone the construction period, it needs to be within a certain range, and the procedure is complicated and takes a long time. As a result, most construction units still have to pay a lot of liquidated damages.

According to Shanghai Jianling Chengda Law Firm, it is necessary to prove the existence of force majeure, the causal relationship between force majeure and the delay of the construction period, and the rationality of applying for the extension of the number of days. Considering the discretion of local courts and different judgment tendencies, the construction period that the contractor can claim to postpone can only be listed to the greatest extent, and it is uncertain whether the construction period can be fully supported by the employer or the referee.

In addition, even if we resume work as scheduled, the investigation and disinfection of epidemic situation at the construction site, the purchase of medical protective equipment, the isolation and disposal of suspected infected personnel, the shortage of labor and materials and the rising cost will push up the project cost. It is understood that most construction engineering materials implement information price, and the current market price has risen sharply. Once the information price adjustment is too low or lagging behind, it will lead to the inversion of information price and material purchase price, resulting in a large number of engineering losses.

(2)Some enterprises are facing the risk of capital chain breakage.,Migrant workers face the risk of unpaid wages.

Some construction enterprises are facing the risk of capital chain breakage, such as shrinking contract output value, idle materials, rising labor costs and untimely payment due to delayed resumption of work. Pay attention to the risk of wage arrears faced by migrant workers after returning to work.

Affected by the epidemic, enterprises were unable to participate in market bidding, and the contract output value shrank. Many expenses, such as damage (repair) expenses of materials and engineering equipment that have been transported to the construction site, rental expenses of engineering machinery and equipment, office rental expenses, wages of managers and left-behind workers that must be paid, and safety maintenance expenses on the construction site, have caused enterprises to face a lot of losses. The suspension and extension of the construction period lead to the failure of enterprises to recover the project funds on schedule, which makes the cash flow of enterprises more tense and the financial expenses increase. Some private construction enterprises’ funds can’t operate normally, and they are in danger of breaking the capital chain. Affected by this, migrant workers face the risk of unpaid wages, and it is more difficult to recover the previously owed wages.

Two or four problems restrict the construction site from returning to work.

On the whole, housing and urban-rural construction departments, construction enterprises and construction units all over the country have invested a lot of manpower, material resources and financial resources to carry out site resumption and on-site epidemic prevention work, but at present, site resumption still faces problems such as shortage of workers, insufficient prevention and control materials and rising prices of building materials.

(A) the shortage of construction workers, it is difficult to recruit workers and it is difficult to return to work.

Fan Jun, secretary of the Party Committee and chairman of Beijing Construction Engineering Group Co., Ltd., said that in recent years, industries such as express delivery have become more attractive to young laborers, and the difficulty in recruiting workers in the construction industry has become increasingly prominent due to problems such as high work intensity, low remuneration level and poor working environment. During this period, affected by the epidemic, some workers were unable to return to Beijing, and some workers needed to be temporarily isolated after returning to Beijing, making it difficult for them to take up their posts for a short time, which led to a more severe situation of "employment difficulties" for enterprises.

Major cities in China are still at high risk and high risk level, and risk prevention and control is strict. Migrant workers need to be isolated for 14 days, and enterprises bear their own costs, which greatly limits the return of workers.

(2)The accommodation conditions on the construction site are difficult to meet the standards, and the construction unit dare not take risks.

Many people in the industry reported that some local governments funded workers to return to work, which eased the pressure on enterprises to some extent. However, after workers reworked, most of them lived in collective dormitories, and the accommodation problem during the 14-day isolation period was difficult to solve.

"Who is the salary during the isolation period after the workers return to Tianjin? Where to isolate? How do workers eat and stay alone? According to the characteristics of site construction, most small and medium-sized enterprises are difficult to do. " Qin Jianfa, chairman of Tianjin Wenling Construction Engineering Co., Ltd., said that once a confirmed case is found on the construction site after the resumption of work, it will immediately stop work and be handled as an accident. Developers and construction units dare not take risks, and everyone is generally cautious about resuming work, preferring to delay the construction period.

(3)Lack of epidemic prevention materials makes it difficult to put prevention and control measures in place.

In the survey, enterprises generally report that there is a big gap in protective materials such as masks, protective clothing and infrared thermometers, which is a common problem that restricts the construction site from returning to work.

The National Development and Reform Commission announced on March 2 that on February 29, the national daily production capacity of masks will reach 110 million, and the daily output will reach 116 million. According to the prediction of the Safety and Health Protection Articles Committee of China Textile Business Association, if the whole country resumes production, the daily demand for masks will reach 500 million. There is still a big gap between supply and demand of epidemic prevention materials.

In Xinxiang City, Henan Province, although there are many manufacturers of epidemic prevention materials, such as masks, which are the main concentration of protective materials manufacturers in Henan Province, after the enterprises fully resume work, the number of employees of industrial enterprises above designated size is about 300,000, and the demand for masks is about 600,000 per day, so the output cannot fully meet the demand.

(4)Unbalanced supply and demand of building materials increases construction cost.

Economic operation is a complete industrial chain cycle. If any link is blocked, upstream and downstream enterprises can’t operate normally. At present, the levels of epidemic prevention and control are different across the country, the conditions of enterprises are different, and the progress of resuming work and production is also different.

According to the investigation, the imbalance between supply and demand of building materials is widespread, and raw materials such as steel bars, cement, sand and gravel are in short supply and prices are rising in some areas.   Article 1 These Measures are formulated for the purpose of implementing the Regulations of Beijing Municipality on the Administration of Books, Newspapers and Audiovisual Markets promulgated by the Standing Committee of the Municipal People’s Congress (hereinafter referred to as the Regulations) and strengthening the management of the books, newspapers and periodicals markets.

  Article 2 The "Regulations" and these Measures must be fully implemented in the distribution and lease of books and newspapers within the administrative area of this Municipality (referring to the wholesale, retail, mail order and consignment, the same below).

  Article 3 The Municipal Press and Publication Bureau is the competent authority of the book and newspaper market in this Municipality, and is responsible for the supervision and management of the distribution and rental of books and newspapers in this Municipality. The district and county cultural administrative organs shall be responsible for the daily management of the books, newspapers and periodicals market within their respective administrative areas.

  Article 4 An entity applying to engage in the business of publishing and renting books and newspapers must have a fixed business place, capital and equipment corresponding to its business scale, and the establishment of outlets shall conform to the development plan of the book and newspaper publishing industry in this Municipality and the market planning of the districts and counties.

  Units applying for the wholesale business of books, newspapers and periodicals, in addition to the above conditions, must also have higher authorities, engaged in retail business for more than three years, and have management personnel with certain business level and cultural knowledge.

  Article 5 An individual applying to engage in the retail and rental business of books, newspapers and periodicals must have a permanent residence in this Municipality and a junior high school education or above, in addition to meeting the provisions of the first paragraph of Article 4 of these Measures.

  No individual may engage in the wholesale business of books, newspapers and periodicals.

  Article 6 Units and individuals applying for the business of publishing and renting books, newspapers and periodicals shall submit relevant materials to the local district or county cultural administrative organ for examination and approval; With the approval of the district and county cultural administrative organs, a business license shall be issued, and the applicant shall apply for a business license from the administrative department for industry and commerce with a certificate.

  The wholesale business of calendars, calendars and New Year pictures is operated by Xinhua Bookstore.   Foreign book and newspaper business units applying for engaging in book and newspaper business activities in this city must hold the approval documents of the local provincial press and publication administrative authorities and report to the Municipal Press and Publication Bureau for approval; If it is approved, it will be issued with a business license and a special certificate for registration with the administrative department for industry and commerce.

  Unless otherwise provided by laws and regulations, those who have not obtained the business license and business license are not allowed to engage in the business of publishing and renting books and newspapers.

  The business license is not allowed to be lent, leased, altered or forged.

  Books, newspapers and periodicals business units or individuals (hereinafter referred to as book and newspaper operators) that change their business location, name, nature, competent department and other matters or close their business shall go through corresponding changes or close their business registration with the original approval authority.

  Seventh postal departments engaged in newspaper distribution business, according to the relevant provisions of the "Postal Law", the provisions of Article 6 of these measures are not applicable. Non-postal personnel who retail newspapers must obtain the approval of the local postal department and wear the newspaper retail market business license printed by the postal department.

  Newspaper employees who sell newspapers published by this newspaper must wear the newspaper retail market business license printed by this newspaper.

  The style of newspaper retail market business license shall be reported to the Municipal Press and Publication Bureau for the record by the issuing unit.

  Article 8 Operators of books, newspapers and periodicals shall abide by the following provisions:

  1. Do not operate beyond the approved mode and scope of operation. Without approval, it is not allowed to operate antique books and newspapers, imported books and newspapers (including Taiwan Province, Hongkong and Macau editions) and internally distributed books and newspapers.

  Two, the unit operating books and newspapers must be purchased from the official publishing unit and the unit approved to engage in wholesale business; Self-employed books, newspapers and periodicals must be purchased from wholesale units in this city. Wholesale units shall not wholesale books, newspapers and periodicals to operators without business licenses.

  Third, it is forbidden to sell or rent books, newspapers and periodicals that propagate and incite against the basic principles set by the Constitution, oppose the Communist Party of China (CPC)’s leadership, deny the socialist system, endanger national security, undermine national unity, and promote obscenity, feudalism, superstition and murder and violence; It is forbidden to sell or rent books, newspapers and periodicals without standard ISBN, uniform ISBN, publishing unit and pricing, and other illegal publications prohibited by the state.

  Four, books and newspapers, advertisements, orders, shall not use low-level, vulgar, obscene language and pictures; Do not make false propaganda. Books issued internally and imported shall not be advertised publicly.

  Five, shall not arbitrarily alter the pricing of books and newspapers or arbitrarily increase the price, shall not be sold with books and newspapers.

  Article 9 Books and periodicals of literature and art and sexual knowledge purchased by wholesale units shall be submitted to the Municipal Press and Publication Bureau for review. The Municipal Press and Publication Bureau shall, within three days from the date of receiving the sample book, make a reply of agreeing or disagreeing with the sales. Without examination or examination by the Municipal Press and Publication Bureau, it is considered that the contents of books and periodicals violate the "Regulations" and the relevant provisions of the state and do not agree to the sale, and the wholesale unit shall not sell or deal with them without authorization.

  Tenth in parks, exhibition halls and other public places to hold books, newspapers and exhibitions, must be reported to the Municipal Press and Publication Bureau for approval before opening, and then according to the relevant provisions of the management of commodity exhibitions and exhibitions.

  Article 11 The Municipal Press and Publication Bureau and the district/county cultural administrative organs may take measures to stop selling, temporarily detain and seal up books and newspapers that are sold or rented in this city and are banned in violation of Article 16 of the Regulations, and deal with them in accordance with the Regulations and relevant state regulations.

  Twelfth in violation of the "Regulations" and these measures, the municipal press and publication bureau or the district/county cultural administrative organ shall give the following penalties:

  First, those who operate books, newspapers and periodicals without a business license, or those who do not operate in the approved fixed place with a business license, shall be banned, all illegally operated books and periodicals and illegal income shall be confiscated, and depending on the seriousness of the case, the unit shall be fined not less than 20,000 yuan from 1000 yuan, and the individual shall be fined not less than 50 yuan and not more than 500 yuan.

  Two, without the approval of the calendar, calendar, New Year pictures, given a warning, confiscation of illegal calendars, calendars, New Year pictures and illegal income; If the circumstances are serious, a fine of more than 20,000 yuan from 1000 yuan may be imposed.

  Three, change or business is not required to register, give a warning or a fine of more than 50 yuan and less than 500 yuan.

  Four, lent, leased, altered business license, given a warning, a fine of more than 100 yuan and 1000 yuan; If the circumstances are serious, the business license shall be revoked, and the business license shall be revoked by the administrative department for industry and commerce.   Five, newspaper workers and personnel approved by the postal department retail newspapers are not required to wear the newspaper retail market business license, given a warning or a fine of more than 5 yuan and less than 50 yuan.

  Eight, the sale of prohibited books and periodicals, confiscate all prohibited books and periodicals and illegal income, and impose a fine of 3 to 5 times the total price of prohibited books and periodicals; If the circumstances are serious, the business license shall be revoked, and the business license shall be revoked by the administrative department for industry and commerce. Those who engage in speculation shall be punished by the administrative department for industry and commerce in accordance with the Provisional Regulations on Administrative Punishment of Speculation. Those who violate the administration of public security shall be punished by the public security organs in accordance with the Regulations of the People’s Republic of China on Administrative Penalties for Public Security. If a crime is constituted, criminal responsibility shall be investigated according to law.

  Nine, wholesale units are not required to submit sample books, give a warning; If the circumstances are serious, the income from unauthorized sales of books and periodicals shall be confiscated, and a fine of more than 20,000 yuan from 1000 yuan may be imposed, until its wholesale business license is revoked.

  Thirteenth in violation of the relevant provisions of advertising, prices, etc., by the Municipal Press and Publication Bureau or the district, county cultural administrative organs in conjunction with the industrial and commercial, price management organs to investigate and deal with according to law.

  Fourteenth books and newspapers market management personnel to check the books and newspapers market, must produce inspection certificates; When withholding or confiscating books, newspapers and periodicals, a uniformly printed collection voucher must be issued; When stopping the sale and sealing up books and newspapers, the seals printed uniformly shall be used; When the operator is punished, a decision on handling illegal cases must be issued. Managers do not implement the above provisions, operators have the right to refuse inspection and punishment. Chapter I General Principles

the second The key information infrastructure mentioned in these Regulations refers to important industries and fields such as public communication and information services, energy, transportation, water conservancy, finance, public services, e-government, national defense science and technology industry, and other important network facilities and information systems that may seriously endanger national security, national economy and people’s livelihood and public interests once they are damaged, lose their functions or have data leaked.

Article Under the overall coordination of the national network information department, the public security department of the State Council is responsible for guiding and supervising the security protection of key information infrastructure. The State Council telecommunications authorities and other relevant departments shall, in accordance with the provisions of these regulations and relevant laws and administrative regulations, be responsible for the security protection, supervision and management of key information infrastructure within their respective functions and duties.

The relevant departments of the provincial people’s government shall, according to their respective responsibilities, implement security protection and supervision and management of key information infrastructure.

Article 4 The security protection of key information infrastructure adheres to comprehensive coordination, division of responsibilities and legal protection, strengthens and implements the main responsibility of key information infrastructure operators (hereinafter referred to as operators), gives full play to the role of the government and all sectors of society, and jointly protects the security of key information infrastructure.

Article 5 The state gives priority to the protection of key information infrastructure, takes measures to monitor, defend and deal with cyber security risks and threats originating from inside and outside People’s Republic of China (PRC), protects key information infrastructure from attack, intrusion, interference and destruction, and punishes illegal and criminal activities that endanger the security of key information infrastructure according to law.

No individual or organization may illegally invade, interfere with or destroy critical information infrastructure, and may not endanger the security of critical information infrastructure.

Article 6 Operators shall take technical protection measures and other necessary measures to deal with network security incidents, prevent network attacks and illegal and criminal activities, ensure the safe and stable operation of key information infrastructure and maintain the integrity, confidentiality and availability of data on the basis of network security level protection in accordance with the provisions of this Ordinance and relevant laws and administrative regulations and the mandatory requirements of national standards.

Article 7 Units and individuals that have made remarkable achievements or made outstanding contributions in the security protection of key information infrastructure shall be commended in accordance with relevant state regulations.

Chapter II Identification of Key Information Infrastructure

Article 8 The competent departments and supervision departments of important industries and fields involved in Article 2 of these Regulations are the departments responsible for the security protection of key information infrastructure (hereinafter referred to as the protection departments).

Article 9 The protection department shall, in combination with the actual situation of this industry and this field, formulate rules for the identification of key information infrastructure and report them to the public security department of the State Council for the record.

The following factors shall be mainly considered in formulating the identification rules:

(a) the importance of network facilities, information systems, etc. to the key core business of this industry and this field;

(two) the degree of harm that may be caused by the destruction, loss of function or data leakage of network facilities and information systems;

(three) the impact on other industries and fields.

Article 10 The protection department is responsible for organizing the identification of the key information infrastructure of the industry and the field according to the identification rules, and notifying the operators of the identification results in time and the public security department of the State Council.

Article 11 If the key information infrastructure changes greatly, which may affect its identification results, the operator shall report the relevant information to the protection department in a timely manner. The protection department shall complete the re-certification within 3 months from the date of receiving the report, and notify the operator of the certification result and the public security department of the State Council.

Chapter III Responsibilities and Obligations of Operators

Article 12 Security protection measures should be planned, constructed and used simultaneously with key information infrastructure.

Article 13 Operators should establish and improve the network security protection system and responsibility system to ensure the input of manpower, financial resources and material resources. The main person in charge of the operator takes overall responsibility for the security protection of key information infrastructure, leads the security protection of key information infrastructure and the handling of major network security incidents, and organizes research and solutions to major network security issues.

Article 14 Operators shall set up special safety management institutions, and conduct safety background review on the persons in charge and key positions of the special safety management institutions. During the examination, the public security organ and the state security organ shall provide assistance.

Article 15 Specialized security management institutions shall be specifically responsible for the security protection of key information infrastructure of their own units and perform the following duties:

(a) to establish and improve the network security management, evaluation and assessment system, and formulate the security protection plan for key information infrastructure;

(two) to organize and promote the construction of network security protection capacity, and to carry out network security monitoring, detection and risk assessment;

(three) according to the national and industrial emergency plans for network security incidents, formulate the emergency plan of the unit, carry out emergency drills regularly, and deal with network security incidents;

(four) identify key positions in network security, organize the assessment of network security work, and put forward suggestions on rewards and punishments;

(5) Organizing education and training on network security;

(six) to fulfill the responsibility of personal information and data security protection, establish and improve the personal information and data security protection system;

(seven) the implementation of security management of key information infrastructure design, construction, operation and maintenance services;

(eight) in accordance with the provisions of the report network security incidents and important matters.

Article 16 Operators should guarantee the operating expenses of special security management institutions and equip them with corresponding personnel, and the personnel of special security management institutions should participate in the decision-making related to network security and informatization.

Article 17 Operators shall conduct network security detection and risk assessment on key information infrastructure at least once a year by themselves or by entrusting network security service agencies, rectify the security problems found in time, and submit the information according to the requirements of the protection department.

Article 18 When a major network security incident occurs in key information infrastructure or a major network security threat is found, the operator shall report to the protection department and the public security organ in accordance with relevant regulations.

In case of major network security incidents such as overall interruption of key information infrastructure or major functional failure, disclosure of national basic information and other important data, large-scale disclosure of personal information, resulting in greater economic losses, widespread dissemination of illegal information, or discovery of major network security threats, the protection department shall, after receiving the report, promptly report to the national network information department and the public security department of the State Council.

Article 19 Operators should give priority to purchasing safe and credible network products and services; If the procurement of network products and services may affect national security, it shall pass the security review in accordance with the national network security regulations.

Article 20 Operators purchasing network products and services shall, in accordance with the relevant provisions of the state, sign a security and confidentiality agreement with the network product and service providers, clarify the technical support and security and confidentiality obligations and responsibilities of the providers, and supervise the performance of the obligations and responsibilities.

Article 21 In case of merger, division, dissolution, etc., the operator shall promptly report to the protection department, and dispose of the key information infrastructure according to the requirements of the protection department to ensure safety.

Chapter IV Guarantee and Promotion

Article 22 The protection department shall formulate the safety planning of key information infrastructure in this industry and field, and define the protection objectives, basic requirements, tasks and specific measures.

Article 23 The national network information department co-ordinates relevant departments to establish a network security information sharing mechanism, timely collects, judges, shares and publishes information on network security threats, vulnerabilities and incidents, and promotes the sharing of network security information among relevant departments, protection departments, operators and network security service agencies.

Article 24 The protection department shall establish and improve the network security monitoring and early warning system for the key information infrastructure in the industry and field, timely grasp the operation status and security situation of the key information infrastructure in the industry and field, notify the network security threats and hidden dangers in early warning, and guide the safety prevention work.

Article 25 The protection department shall, in accordance with the requirements of the national emergency plan for cyber security incidents, establish and improve the emergency plan for cyber security incidents in its own industry and field, and organize emergency drills regularly; Guide operators to deal with network security incidents, and organize and provide technical support and assistance as needed.

Article 26 The protection department shall regularly organize the network security inspection and detection of key information infrastructure in this industry and field, and guide and supervise operators to timely rectify potential safety hazards and improve safety measures.

Article 27 The national network information department co-ordinates the public security department and protection department of the State Council to check and detect the network security of key information infrastructure, and puts forward improvement measures.

Relevant departments should strengthen coordination and information communication when carrying out network security inspection of key information infrastructure, so as to avoid unnecessary inspection and overlapping inspection. No fees shall be charged for the inspection work, and the inspected units shall not be required to buy products and services of designated brands or designated production and sales units.

Article 28 Operators shall cooperate with the network security inspection and testing of key information infrastructure carried out by the protection department, as well as the network security inspection of key information infrastructure carried out by the relevant departments of public security, national security, confidentiality administration and password management according to law.

Article 29 In the security protection of key information infrastructure, the national network information department, the competent telecommunications department in the State Council and the public security department in the State Council should provide timely technical support and assistance according to the needs of the protection department.

Article 30 The information obtained by the network information department, the public security organ, the protection department and other relevant departments, the network security service institutions and their staff can only be used to maintain network security, and ensure information security in strict accordance with the requirements of relevant laws and administrative regulations, and shall not be leaked, sold or illegally provided to others.

Article 31 Without the approval of the national network information department and the public security department of the State Council or the authorization of the protection department and operators, no individual or organization may carry out activities such as vulnerability detection and permeability testing on key information infrastructure that may affect or endanger the security of key information infrastructure. The implementation of vulnerability detection, permeability testing and other activities on the basic telecommunications network shall be reported to the competent telecommunications department of the State Council in advance.

Article 32 The state takes measures to give priority to ensuring the safe operation of key information infrastructures such as energy and telecommunications.

The energy and telecommunications industries should take measures to provide key guarantees for the safe operation of key information infrastructure in other industries and fields.

Article 33 Public security organs and state security organs shall, in accordance with their respective duties, strengthen the security of key information infrastructure in accordance with the law, and prevent and crack down on illegal and criminal activities against and using key information infrastructure.

Article 34 The state formulates and improves the safety standards of key information infrastructure, and guides and regulates the safety protection of key information infrastructure.

Article 35 The state takes measures to encourage network security professionals to engage in the security protection of key information infrastructure; Incorporate the training of operators’ safety management personnel and safety technicians into the national continuing education system.

Article 36 The state supports the technological innovation and industrial development of key information infrastructure security protection, and organizes forces to tackle key information infrastructure security problems.

Article 37 The state strengthens the construction and management of network security service institutions, formulates management requirements and strengthens supervision and guidance, constantly improves the ability level of service institutions, and gives full play to their role in the security protection of key information infrastructure.

Article 38 The state strengthens network security, and integration of defense and civilian technologies, the military and the land cooperate to protect the security of key information infrastructure.

Chapter V Legal Liability

Article 39 In any of the following circumstances, the operator shall be ordered to make corrections and given a warning by the relevant competent authorities according to their duties; Those who refuse to correct or lead to the consequences of endangering network security shall be fined between 100,000 yuan and 1 million yuan, and those who are directly in charge shall be fined between 10,000 yuan and 100,000 yuan:

(1) Failing to report the relevant information to the protection department in time when the key information infrastructure has changed greatly, which may affect its identification result;

(two) the safety protection measures are not synchronized with the key information infrastructure planning, construction and use;

(3) Failing to establish and improve the network security protection system and responsibility system;

(four) there is no special safety management organization;

(5) Failing to review the safety background of the person in charge of the specialized safety management institution and the personnel in key positions;

(six) to carry out decisions related to network security and informatization without the participation of personnel from special security management institutions;

(seven) the specialized safety management agencies failed to perform the duties stipulated in Article 15 of these regulations;

(8) Failing to conduct network security detection and risk assessment on key information infrastructure at least once a year, failing to rectify the security problems found in time, or failing to submit the information according to the requirements of the protection department;

(nine) purchasing network products and services, and failing to sign a security agreement with the network product and service provider in accordance with the relevant provisions of the state;

(ten) the merger, division, dissolution, etc., did not report to the protection department in time, or did not dispose of the key information infrastructure in accordance with the requirements of the protection department.

Article 40 If the operator fails to report to the protection department and the public security organ in accordance with the relevant provisions when a major network security incident occurs or a major network security threat is discovered in the key information infrastructure, the protection department and the public security organ shall order it to make corrections and give a warning according to their duties; Those who refuse to correct or lead to the consequences of endangering network security shall be fined from 100,000 yuan to 1 million yuan, and those who are directly in charge shall be fined from 10,000 yuan to 100,000 yuan.

Article 41 If an operator purchases network products and services that may affect national security and fails to conduct security review in accordance with the national network security regulations, the national network information department and other relevant competent departments shall order it to make corrections according to their duties, and impose a fine of more than 1 time and less than 10 times the purchase amount, and impose a fine of more than 10,000 yuan and less than 100,000 yuan on the directly responsible person in charge and other directly responsible personnel.

Article 42 Operators of key information infrastructure network security inspection and testing work carried out by the protection department, and public security, national security, confidentiality administration, password management and other relevant departments in accordance with the law to carry out key information infrastructure network security inspection work does not cooperate, by the relevant competent departments shall be ordered to make corrections; Refuses to correct, a fine of 50 thousand yuan to 500 thousand yuan, and a fine of 10 thousand yuan to 100 thousand yuan for the directly responsible person in charge and other directly responsible personnel; If the circumstances are serious, the corresponding legal responsibilities shall be investigated according to law.

Article 43 If the activities that illegally invade, interfere with or destroy key information infrastructure and endanger its security do not constitute a crime, in accordance with the relevant provisions of the Cyber Security Law of the People’s Republic of China, the illegal income shall be confiscated by the public security organs, and they shall be detained for less than 5 days, and may also be fined between 50,000 yuan and 500,000 yuan; If the circumstances are serious, they shall be detained for more than 5 days and less than 15 days, and may be fined more than 100,000 yuan and less than 1 million yuan.

If a unit commits the acts mentioned in the preceding paragraph, the illegal income shall be confiscated by the public security organ, and a fine of 100,000 yuan to 1 million yuan shall be imposed, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions of the preceding paragraph.

In violation of the provisions of the second paragraph of article fifth and the provisions of article thirty-first, the personnel who are punished by public security management shall not engage in the work of key positions in network security management and network operation within 5 years; Persons who are subject to criminal punishment shall not engage in key positions in network security management and network operation for life.

Article 44 If the network information department, the public security organ, the protection department and other relevant departments and their staff fail to perform the duties of security protection, supervision and management of key information infrastructure or neglect their duties, abuse their powers or engage in malpractices for selfish ends, the directly responsible person in charge and other directly responsible personnel shall be punished according to law.

Article 45 Public security organs, protection departments and other relevant departments charge fees in the network security inspection of key information infrastructure, or ask the inspected units to buy products and services of designated brands or designated production and sales units, and their higher authorities shall order them to make corrections and refund the fees charged; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law.

Article 46 Network information departments, public security organs, protection departments and other relevant departments, network security service institutions and their staff use the information obtained in the security protection of key information infrastructure for other purposes, or disclose, sell or illegally provide it to others, the directly responsible person in charge and other directly responsible personnel shall be punished according to law.

Article 47 If a major and particularly major network security incident occurs in key information infrastructure and is determined as a liability accident after investigation, the responsibilities of the operators should be ascertained and investigated according to law, and the responsibilities of relevant network security service institutions and relevant departments should also be ascertained. Those who have dereliction of duty, dereliction of duty and other illegal acts should be investigated according to law.

Article 48 Operators of e-government key information infrastructure fail to fulfill the obligations of network security protection stipulated in these regulations, and shall be dealt with in accordance with the relevant provisions of the Network Security Law of the People’s Republic of China.

Article 49 Anyone who violates the provisions of these regulations and causes damage to others shall bear civil liability according to law.

In violation of the provisions of this Ordinance, which constitutes a violation of public security administration, the public security administration shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VI Supplementary Provisions

Article 50 The security protection of key information infrastructure for storing and processing state secret information shall also comply with the provisions of confidentiality laws and administrative regulations.

Article 51 These Regulations shall come into force as of September 1, 2021.
